User and Oddroad.com Agreement

Welcome to the official website of Oddroad Holidays Pvt. Ltd. (“Oddroad”), having its registered office at #405, Royal Manor, Royal Enclave Layout, Srirampura, PO Jakkur, Bangalore-560064, Karnataka, India.  This website viz. www.oddroad.com (“Site”) is owned and operated by Oddroad Holidays Pvt. Ltd. (‘Oddroad’ or 'we' or 'us'). The Site is offered to you with effect from February 01, 2013, subject to your acceptance without modification, the terms, conditions and notices contained herein. Your use of the Site constitutes your agreement to all such terms, conditions, and notices (“Terms”). If you disagree with any part of the Terms mentioned below, you must not use the services of Oddroad.

The Terms are effective upon acceptance and governs the relationship between the user of the Site (“you” or the “User”, as the context may necessitate) and Oddroad including the services availed of on the Site. Additionally, the Oddroad.com may contain terms pertaining to particular features or offers (for example, flights, hotels, packages etc.) In the event that any of the terms, conditions, and notices contained herein conflict with the additional terms or other terms and guidelines contained within the Site, then these terms shall prevail. The Terms set out in the Site may be altered / amended from time to time depending on the policies of Oddroad and the prevailing market conditions. We request you to look through them as often as possible as it may not be possible for us to intimate you on every change that occurs in these Terms.

Definitions

In this document, terms that commence with a capital letter are defined in this Section or in the preamble.

• "Content" means the text, documents, information, data, articles, images, photographs, graphics, software, applications, video recordings, audio recordings, sounds, designs, features, and other materials that are available on the Site.
• "Content" also includes Marks and Products and Services.
• "Mark" means trademark, trade name, service mark, trade dress, logo, custom graphics, or icon.
• "Member" means an individual who has registered with the Site. Members choose a Member ID and a password.
• "Member ID" means the e-mail address you use (with your password) to login to our Site.
• "Oddroad" or "we" means Oddroad, and its subsidiaries and affiliates.
• "Products and Services" means the airline travel, hotel accommodation, car rental, ground transportation, tours, theater tickets, attractions, travel insurance, care alerts, fare alerts and other items available through the Site.
• "Provider" means Oddroad's licensors, suppliers, information providers, and travel and leisure service providers.
• "Purchase" means to book, reserve, or purchase.
• The terms "Site", "Marks", "Content" and "Products and Services" do not include the sites, marks, content, products or services that are provided by third parties, and that are available through a link from the Site. Their use is subject to the terms set forth by their respective owners or operations, on the third party's website.
• "Site" means the www.Oddroad.com website and/or the www.Oddroad.co.in website, and their respective subsites, together with the respective Content, Marks, Products and Services available from these sites and subsites.

Accuracy of Contents

To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this Site. We shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this Site.

Eligibility to Use

Use of the Site/s is available only to persons who can form legally binding contracts as per the laws of India. Oddroad reserve the right to terminate your subscription and / or refuse to provide you with access to the Site if it is discovered that you have not attained majority as per the laws of India.

You may not have more than one account. Maintaining more than one account by an user shall amount to fraudulent act on part of the user and attract actions against such user in accordance with the Terms. If you are registering as a business entity, you represent that you have the authority to bind the entity to these Terms. Additionally, you are prohibited from selling, trading, or otherwise transferring your Site account to another party. Oddroad owns no responsibility in any manner over any dispute arising out of transactions by any third party using your account/e-mail provided by you to Oddroad or payments made by your credit card by any third party.

Account Information of User

While registering for My Account, the user will choose a password and is responsible for maintaining the confidentiality of the password and account.

In consideration of your use of the Site, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws as applicable in India. You also agree to provide true, accurate, current and complete information about yourself as prompted by our Site’s registration form. If you provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of our Site (or any portion thereof).

We will protect your information in accordance with our Privacy Policy. The user is fully responsible for all activities that occur while using their password or account. It is the duty of the user to notify Oddroad immediately of any unauthorized use of their password or account or any other breach of security. Oddroad will not be liable for any loss that may be incurred by the user as a result of unauthorized use of their password or account, either with or without their knowledge. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to refuse service, terminate accounts, or remove or edit content in its sole discretion.

Oddroad Services Usage

The Site may contain services such as email, information related to various tourist spots, personal web pages, and/or other messages. You agree to use the services only to post, send and receive messages and material that are proper and related to the particular service. By way of example, and not as a limitation, you agree that when using a service, you will not:

• Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
• Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
• Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
• Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
• Advertise or offer to sell or buy any goods or services for any business purpose, unless specifically allowed.
• Conduct or forward surveys, contests, pyramid schemes or chain letters.
• Download any file posted by another user that you know, or reasonably should know, cannot be legally distributed in such manner.
• Violate any code of conduct or other guidelines, which may be applicable for or to any particular service.
• The user should take particular care while disclosing any identifying information in any service, which may be identifiable.
• Violate any applicable laws or regulations for the time being in force in or outside India.
• Frame, Link, mirror, scrape, spider or data mine the Website or authorize, instruct, hire, employ, or otherwise cause anyone to Frame, Link, mirror, scrape, spider or data mine the Website.
• Violate any of the terms and conditions of the user agreement or any other terms and conditions for the use of Site contained elsewhere herein.

Oddroad has no obligation to monitor the services. However, Oddroad reserves the right to review materials posted and to remove any materials in its sole discretion. Oddroad reserves the right to terminate the user’s access to any or all of the services at any time without notice or any reason whatsoever.

Oddroad reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Oddroad’s sole discretion.

Oddroad does not control or endorse the content, messages or information found in any service and, therefore, specifically disclaims any liability or responsibility whatsoever with regard to the services and any actions resulting from the users participation in any service.

Materials uploaded to a service may be subject to posted limitations on usage, reproduction and/or dissemination; User is responsible for keeping himself/herself updated of and adhering to such limitations if they download the materials.

Oddroad also reserves the right, in its sole discretion, to terminate the access to any or all Oddroad websites and related services or any portion thereof at any time, without notice.

Credit Card Details

You agree, understand and confirm that the credit card details provided by you for availing of services on our Site will be correct and accurate and you shall not use the credit card which is not lawfully owned by you, i.e. in a credit card transaction, you must use your own credit card. You further agree and undertake to provide the correct and valid credit card details when making payment on our Site. We do not be store any information related to your credit card or net banking. In case we do not receive authorization from the respective bank or the transaction gets interrupted due to any reason, the transaction will be treated as failed and no order will be marked for that transaction. In this case, if any amount has been deducted from your account, the same will be refunded back. At no event, we will be liable for any credit card fraud that occurs to you. The liability for use of a card fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively on you.

Security & Privacy

The user hereby consents, expresses and agrees that he has read and fully understands the Privacy Policy of Oddroad contained in Site/s and he hereby consents that the terms and contents of such Privacy Policy are acceptable to him.

Services and Content Availability

We will use our reasonable commercial efforts to keep our Site available on a 24-hour/7-day-a- week basis, subject to necessary scheduled downtime for maintenance, unscheduled maintenance, and system outages. We cannot promise that access to the Site will be uninterrupted or available at all times. We assume no liability or responsibility for any delay, interruption or downtime.

Content

Although Oddroad makes every effort to ensure that the description and content on each page of the site is correct, it does not, however, take responsibility for changes that occur due to human, data entry errors or for any loss or damages suffered by any user due to any information contained herein. Also, Oddroad does not own or operate airlines and other suppliers and cannot therefore control or prevent changes in the published descriptions. Oddroad, therefore, reserves the right to make such changes and in the event of you placing an order with us or choosing to avail of our services, the same will be communicated to you before the confirmation invoice is made.

You should not take any action based on information on this Site until you have received a confirmation of your transaction. We send confirmations within 24 hours of your Purchase. If you have not received a confirmation of your purchase via e-mail, first look into your "spam" or "junk" folder to verify that it has not been misdirected, and if still not found, please contact our customer service department. The Contact Information is provided on our customer service page.

Viruses

We make reasonable attempts to exclude viruses from the Site, but cannot ensure that the Site will be at all times free from viruses or other destructive software. You are urged to take appropriate safeguards before downloading information from the Site. We assume no responsibility for any damages to computer equipment or other property that may result from use of the Site or downloading anything from the Site.

International Travel

Although most travel, including travel to international destinations is completed without incident, travel to certain destinations may involve greater risks than others. We urge you to review and evaluate travel prohibitions, warning, announcements, and advisories issued by the government and the aviation administration before booking travel to international destinations.

By offering for sale travel to particular international destinations, Oddroad does not represent or warrant that travel to such point is advisable or without risk. Oddroad does not accept liability for damages, losses, or delays that may result from improper documents for entry, exit, length of stay, or from travel to such destinations.

Baggage Allowance and Restrictions 

The fares mentioned in the Site do not include any Baggage fees. Baggage allowance and restrictions will apply to all airlines and are subject to change at any time. We recommend you to check with the airline you are traveling with to verify the specific Baggage restrictions. You may be charged additional fees each time you go over the size and/or weight allowances. Please note that fees for Baggage are paid for directly to the airline and can change at any time.

Baggage Policy on Connecting Flights

In the event the passenger is boarding connecting flights, the passenger is requested to collect his baggage at the connecting airport and check-in again to continue the journey. If the passenger has any excess baggage, he is required to pay any excess baggage fee specified by the respective airline. Any such fee is to be paid to the airline directly upon using such service.

Multiple Airlines Itineraries

The user acknowledges that in the event his itinerary consists of more than one airline there shall be two separate fare rules and policies applicable to him inter-alia relating to differences in baggage fees, refunds, special requests etc. In the event of a schedule change, if the user’s initial flight is cancelled or if the schedule is changed, the second airline with which you booked your return will not obligated to issue any refund or reschedule. The user acknowledges that it is his responsibility and he shall ensure that he complies with the respective airline’s rules and policies. You are responsible for complying with each airline's terms and conditions.

Special Requests

The user acknowledges that any requests made by the user for availability of any seat, meals, frequent flyer & other special options are a request only and that the same cannot be guaranteed. The respective airline will have the right to apply any amendments to the requested seat allocation without any prior notification. The user shall verify all requests with the respective airline. It is therefore recommended to contact the respective airline directly to confirm any requests made by you.

Passports/Visas/Health Requirements 

Prior to booking your trip, you have to ensure that you meet the passport, visa, affidavit, health and other requirements of the countries you wish to visit and those that you transit (even if it is for a plane change).

Unaccompanied Minors

We request the user to read and familiarize themselves in regards to children travelling unaccompanied without an adult over the age as defined in the specific airlines’ age related guidelines. You may verify the unaccompanied minor rules and restrictions with the operating airline(s) prior to confirming your booking online. The unaccompanied minor service requirements vary from one airline to another and children will be denied boarding and the entire fare paid will be forfeited in the event you fail to meet such requirements. We will not be held responsible for any fees or passengers denied boarding due to the non compliance of the airlines rules and regulations regarding unaccompanied minors.

Check-in / Boarding Times

We will not be responsible for any passengers who check-in past the prescribed airline cut off times. Any failure by any passenger to meet check-in times may result in denial of boarding, loss of assigned seat selection, cancellation of booking and forfeiture of fare paid. The passenger has to ensure that he/she has to make the check-in atleast prior to 120 minutes for domestic flights and 180 minutes for international flights.

Supplier Rules and Restrictions

Various hotels may have different procedures for their booking process. In certain cases, you may be required to provide your credit card details or pay in advance to meet any additional expenses that may arise during your stay. Any such details provided or payment made by you is unrelated to any payment received by Oddroad for your hotel booking with the supplier.

You may be required to abide by and comply with certain conditions and rules laid down by the supplier. Any violation of any such supplier's rules and restrictions may result in cancellation of your booking(s) as per the policies of the supplier and any amount paid for such booking will be forfeited.

Travel Destinations

The user acknowledges that travel to certain destinations may involve greater risk than others. Oddroad requests the users to review the travel prohibitions, warnings, announcements and advisories issued by the Canadian government from time to time prior to availing the services on the Website to travel to international destinations.

Links to Third Party Sites

The Oddroad websites may contain links to other websites. The linked sites are not under the control of Oddroad and hence, Oddroad is not responsible for the content of any linked site, or any changes and updates to a linked site. Oddroad is providing these links to you only as a convenience, and the inclusion of any link does not entail endorsement by us of the site or any association with its operators or owners

Inbound Links

We welcome links from a third party site to the home page of our Site, through a plain text link, provided that

• You give Oddroad prior written notice of such link by contacting Oddroad Customer Service, to request Oddroad's permission to establish the link
• You do not imply in any fashion that Oddroad is endorsing any of your products or service or is affiliated with you
• You discontinue providing a link to our Site if so requested by Oddroad
• You do not present Oddroad in a false light, or provide misleading or false information about Oddroad, or its Site or Services
• You do not use any Mark of Oddroad; and
• You do not replicate, frame or mirror the content of the Site.

• We reserve the right to require you to remove links to the Site, in our sole discretion.

Linking to any page of the Site other than to the homepage is strictly prohibited in the absence of a separate linking agreement with Oddroad.

Liability of Oddroad

Since Oddroad acts only as a booking agent, it accepts no liability whatsoever for any part of the arrangements between the supplier and the customer with regard to the standard of service. In no circumstances shall Oddroad be liable for the services provided by the supplier/third party.

Reviews, Feedback, Submissions

All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered on or by our Site, submitted or offered in connection with your use of this Site (collectively, the “Comments”) shall be and remain our property. Such disclosure, submission or offer of any Comments shall constitute an assignment to us of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. Thus, we own exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments. We will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display and distribute any Comments you submit for any purpose whatsoever, without restriction and without compensating you in any way. We are and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay you any compensation for any Comments; or (3) to respond to any Comments. Oddroad and its licensors retain all right, title and interest (including all copyright, trademark, patent, trade secrets, and all other intellectual property rights) in the Site. The Site is protected by copyright, trademark, patent, trade secrets, unfair competition, and other laws of worldwide, through the application of local laws or international treaties. Any unauthorized use, reproduction or modification of this Site may violate such laws.

Trademarks

ODDROAD and all other Marks that appear, are displayed, or used on the Site are registered or common law trademarks or service marks of Oddroad and its Providers. These Marks may not be copied, downloaded, reproduced, used, modified, or distributed in any way without prior written permission from Oddroad or the relevant Provider, except as an integral party of any authorized copy of the Content.

Your Comments and Submissions

Any communications or materials you transmit to Oddroad, through the Site, by electronic mail or otherwise, including any data, question, comments, rating of a property or attraction, suggestion, idea, or the like ("Communications or Materials") will be treated as non-confidential and non-proprietary. By voluntarily submitting to us, or by posting on the Site any Communications or Materials, you grant Oddroad, and all users of the Site, a worldwide, non-exclusive, royalty free, perpetual, irrevocable, and fully sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from distribute, and display such Communications or Materials in any form, media or technology. We assume no responsibility for any Communications or Materials posted or submitted, or for the return or such Communications or Materials. We want your feedback and appreciate your ideas and suggestions, but we are unable to answer every comment individually.

Fees

Oddroad reserves the right to charge transaction fees based on certain completed transactions using its services. The user shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the services. Oddroad further reserves the right to alter any and all fees from time to time, without notice.

Disclaimer of Warranty

Oddroad and its Providers make no warranty of any kind regarding the Site, Content, Products or Services, all of which are provided on an "as is" basis. Oddroad and its Providers expressly disclaim any representation or warranty that the Site will be free from errors, viruses or other harmful components, that communications to or from the Site will be secure and not intercepted, that the Services and other capabilities offered from the Site will be uninterrupted, or that its Content will be accurate, complete or timely. The fact that Oddroad is including or offering any Product or Service on the Site is not an endorsement or a recommendation of the Product or Service.

OTHER THAN THOSE WARRANTIES WHICH, UNDER THE LAWS APPLICABLE TO THESE TERMS, ARE IMPLIED BY LAWS, AND ARE INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION, ODDROAD AND ITS PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS, INCLUDING IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE.

Limitation of Liability

Subject to applicable law, use of this Site and its Content is at your sole risk. Services and Products made available on this Site are subject to conditions imposed by the Providers, including but not limited to tariffs, conditions of carriage, international conventions and arrangements, and federal government regulations. Providers who furnish products or services through this Site are independent contractors, and not agents or employees of Oddroad. IN NO EVENT WILL ODDROAD OR ITS PROVIDERS BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, SPECIAL OR OTHER CONSEQUENTIAL DAMAGES FOR ANY USE OF THIS SITE, ANY HYPER LINKED WEB SITE, THE ACTS OR OMISSIONS OF PROVIDERS WHO FURNISH PRODUCTS OR SERVICES THROUGH THIS SITE, OR THE PRODUCTS OR SERVICES OFFERED BY PROVIDERS THROUGH THIS SITE, INCLUDING, WITHOUT LIMITATION, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, THAT ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH(I) ANY USE OF, BROWSING OR DOWNLOADING OF ANY PART OF OUR SITE OR CONTENT, (II) ANY FAILURE OR DELAY (INCLUDING WITHOUT LIMITATION THE USE OF OR INABILITY TO USE ANY COMPONENT OF THIS SITE FOR RESERVATIONS OR TICKETING), OR (III) THE PERFORMANCE OR NON PERFORMANCE BY US OR ANY PROVIDER, OR (IV) ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, EVEN IF ODDROAD AND THE PROVIDER(S) HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES TO SUCH PARTIES OR ANY OTHER PARTY.

If, despite the limitation above, Oddroad or a Provider is found liable for any loss or damage which arises out of or is in any way connected with any of the occurrences described in the limitation above, then Oddroad and the Providers' liability will in no event exceed, in total, the sum of Rs. 5,000.

Indemnification

The user agrees to indemnify, defend and hold harmless Oddroad and/or its affiliates, partner websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Oddroad and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this Term.

Terms and Conditions of Travel Services (Reservations, Bookings and Purchases)

You agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal. A supplier that is an air carrier is required to make available to the public the terms of its contract of carriage, and we make available the fare rules for all air carrier tickets before purchase.

The circumvention of an air carrier's rules, including practices such as back-to-back ticketing (purchasing two or more tickets with overlapping travel dates in order to circumvent minimum stay requirements) and hidden-city ticketing (purchasing tickets including segments which the purchaser does not intend to use in order to circumvent an air carrier's pricing structure), is prohibited by many air carriers. The use of prohibited ticketing practices may result in the air carrier taking actions including the cancellation of the ticket, denied boarding, revocation of frequent flier miles and other benefits, additional charges to the purchaser's credit card, additional charges collected at the airport, or future invoicing.

You are responsible for ensuring that your purchases abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including terms and conditions of purchase set forth in an air carrier's fare rules or contract of carriage.

Arbitration of Disputes

If any dispute arises between you and Oddroad during your use of the Site or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of the Terms and Conditions, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by Oddroad. The place of arbitration shall be Bangalore. The arbitration proceedings shall be in the English language and shall be in accordance to the provisions of the Arbitration and Conciliation Act, 1996. The Terms and Conditions shall be governed and construed in accordance with the laws of India.

User Agreement

Oddroad is not responsible for any errors, omissions or descriptions on any of its pages or on any links or on any of the linked website pages. The users are requested to verify the accuracy of all information before undertaking any reliance on such information.

The linked sites are not under the control of Oddroad and Oddroad is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. Oddroad is providing these links to the users only as a convenience, and the inclusion of any link does not imply endorsement of the site by Oddroad.

In case of any dispute between user and Oddroad pertaining to the validity, interpretation, implementation or alleged breach of any provision of the Terms and Conditions, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by Oddroad. The place of arbitration shall be Bangalore and the arbitration proceedings shall be in the English language. The Terms and Conditions shall be governed and construed in accordance with the laws of India.

To the extent Oddroad acts only as a planning interface and facilitator of Services between its User and third party service providers, it shall not have any liability whatsoever for any aspect of the arrangements between the service provider and the User as regards the standards and rendering of services by the service providers. In no circumstances shall Oddroad be liable for the services provided by the service provider.

Also, Oddroad is not the service provider and cannot therefore control or prevent changes in the published descriptions or representations, which are always based upon information provided by the service providers. Oddroad acts only as a facilitator of Services and shall not be held liable for any changes, deficiencies, disputes, etc. related to the services being provided by Service Providers, including the matters related to delays in refunds or no refunds, of the fares and charges paid to Service Providers.

Oddroad does not endorse any advertiser or travel / tour partner on its Site in any manner. The Users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.

Oddroad does not, by offering travel related services to particular destinations, represent or warrant that travel to such destinations is without risk, and shall not be liable for damages or losses that may result from travel to such destinations.

Through this Site you are able to link to other websites which are not under the control of Oddroad. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

If, despite the limitation above, Oddroad or a Provider is found liable for any loss or damage which arises out of or is in any way connected with any of the occurrences described in the limitation above, then Oddroad and the Providers' liability will in no event exceed, in total, the sum of Rs. 5,000.

Indemnification

The user agrees to indemnify, defend and hold harmless Oddroad and/or its affiliates, partner websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Oddroad and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this agreement.

Amendment or Cancelation Policy

Oddroad believes in helping its customers as far as possible, and has therefore a liberal cancellation policy. You can request an amendment or cancellation of a paid plan by mailing to amend@oddroad.com. To amend/cancel your paid plan offline, contact Oddroad’s Tour Partner who has planned your trip. For any cancellation, Oddroad (& its relevant tour partner) will charge relevant cancellation charges based on modes of travel, accommodation, days remaining for trip start date, etc of a paid plan.

You may be required to directly contact the nearest airline office (of the concerned airline) to get your flight reservation cancelled.

How do I get a refund after canceling my plan?

In case of partial or complete cancellation, the refund shall be processed within 15 - 20 working days from the date of the cancellation request being made. If we have received the payment through a valid credit card, then the same will be refunded to your credit card. Payments made using any other form of payment will be refunded by cheque within a maximum of 30 days from date of cancellation. All refunds shall be processed subject to processing of refunds by the respective airline/service provider.

What are the cancellation/amendment charges?

Cancellation and/or amendment of airline / train / bus / taxi tickets shall at all times be subject to fees/charges/levies/payments as may be levied/payable to the relevant airline / train / bus / taxi in accordance with such relevant airline / train / bus / taxi cancellation/refund policy. Prior to booking tickets, you must acquaint yourself with the relevant airline / train / bus / taxi cancellation/refund policy with respect to the ticket to be booked by you. Any cancellation/amendment fees / charges / levies / payments levied by/payable to the relevant airline / train / bus / taxi, shall be to your account.

Except to the extent stated in the individual airline / train / bus / taxi terms and conditions or otherwise applicable to specific tickets booked/issued, cancellation fee are payable as follows.

For each domestic flight cancellation in your plan, Oddroad will charge Rs. 250 per person per sector as standard cancellation charges, over and above the airline & Oddroad’s tour partner’s own cancellation charge. While for international flight bookings a standard fee of Rs 500 per person would be charged, over and above the airline & Oddroad’s tour partner’s own cancellation charge.

Please refer to airline specific amendment and cancellation policy while using our Site. You may be required to directly contact the nearest airline office (of the concerned airline) to get your reservation cancelled. All flight cancellations must be made as per the time limit defined in the cancellation policy of specific airlines. No flight cancellations are allowed once you have completed web check-in!

To cancel the tickets offline, you are requested to call Oddroad’s specific tour partner who has booked the flight for you.

For cancellation of tickets within 4 hours of the scheduled departure of the flight booked, the user will have to contact the nearest airline office (of the concerned airline) to get his/her reservation cancelled. We are in no way responsible to ensure that the ticket shall be cancelled and the sole liability to confirm the same with the airline shall lie with the user. Once the tickets are issued‚ name changes or any other correction will not be permitted.

The customer must read individual airline / train / bus / taxi specific terms and conditions in order to find out if the ticket proposed to be booked/purchased is subject to any additional cancellation fee or charge and Oddroad assumes no liability whatsoever in this regard. Note: Unless expressly stated otherwise, it is mandatory to contact Oddroad (& its relevant tour partner) for refunds and the airline / train / bus / taxi will route the refund for your tickets booked on the Website, through Oddroad (& its relevant tour partner).

The above mentioned cancellation process and refund processing time may vary. In case of lost or damaged tickets, the refund process cannot be initiated with the airline / train / bus / taxi. Refund would be through cheque or demand draft.

In case a hotel reservation, and are, thereafter, not contactable on the contact details provided in this regard, then the hotel reservation selected by you will stand cancelled and Oddroad (& its relevant tour partner) would not be liable for any charges/expenses incurred by you, either directly or indirectly in this regard. Any hotel reservation cancellation would be bound by that particular hotel’s terms & conditions of cancellation or amendment. Oddroad will charge Rs. 250 per hotel as standard cancellation charges, over and above the hotel & Oddroad’s tour partner’s own cancellation charges. The customer must read such T&Cs of each & every hotel listed in the itinerary.

In case of cancellation of a complete itinerary, Oddroad’s tour partner shall charge cancellation charges as per the cancellation policy mentioned at the time of the booking & in the mailed itinerary. The customer must read the specific cancellation policy at the time of booking as well as when cancelling an itinerary.

Delivery of Products / Services 

What is an e-Ticket?

An e-Ticket is a paperless electronic document with a unique confirmation number given to passengers in place of a paper ticket. Passengers are required to produce the unique confirmation number at the airport airline / train / bus / taxi counter to claim the e-Ticket.

How will I get my e-Ticket details?

Your e-Ticket details will be sent to your email address provided by you as well as be available in your Itinerary on logging in with your Oddroad id & password after making the payment for your booking. In case you do not have an email address, the details will be given to you over the phone.

If you do not receive your e-ticket within 24 hours of making your booking on Oddroad.com, please call a Customer Care Representative at: +91 9483519754. 
Oddroad (& its relevant tour partner) shall not be liable if customers do not comply with this requirement.

Paper Tickets

Oddroad (& its relevant tour partner) does not deliver any paper tickets until & unless specified by an airline / train / bus service provider.

Is it necessary to show my Oddroad Reference Number Confirmation email?

It is not mandatory to show your Oddroad Reference Number Confirmation email. In case you are not carrying the Oddroad Reference Number Confirmation email, you will need to show a photographic identity proof (passport, driver's license etc.) at the airport / railway / bus station / check-in counter (in train in case of railway ticket) of the airline / train / bus. However, it is advisable that you carry your Oddroad Reference Number Confirmation email and e-Ticket together.

Is it necessary to carry my e-ticket with me?

Yes, it is mandatory for you to carry a copy of your e-ticket as sent by Oddroad.com (& its relevant tour partner). In the event that you fail to present a copy of your e-ticket, Oddroad (& its relevant tour partner) will not be held responsible if the Airline / Train / Bus does not issue a boarding pass/ disallows you from traveling.

How will I get my boarding pass for an e-Ticket?

You will need to show your e-Ticket confirmation email and e-Ticket number along with a photographic identity proof (passport, driver's license etc.) at the airport / railway / bus station / check-in counter (in train in case of railway ticket) of the airline / train / bus / taxi. The Airline / Train / Bus representative will issue your boarding pass at that time.

Prepaid Ticket Advice ("PTA")

A PTA is a Prepaid Ticket Advice. We will give you a PTA number that you need to present at the airport check-in counter of the airline. The airline representative will print and give you your ticket at that time.
